### ⚖️ INJUNCTIONS & STAY ORDERS
**Protect your rights before the situation becomes irreversible.**
In a civil dispute, winning the case years later may not be enough if the other party has already:
🏠 **Sold or transferred disputed property** 🏗️ **Started construction or demolished a structure** 🚧 **Blocked your pathway or access** 💰 **Attempted to encash a disputed bank guarantee** ™️ **Misused your business or trade name** 📄 **Created third-party rights during the litigation**
This is where an **urgent Temporary Injunction under Order XXXIX CPC** can become critical.
The Court may, depending on the facts and urgency of the matter, restrain the opposite party from taking further steps until the dispute is decided.
### 🔑 WHAT DOES THE COURT CONSIDER?
Generally, three important principles are examined:
**1️⃣ Prima Facie Case** Do you have a genuine and arguable legal right requiring protection?
**2️⃣ Balance of Convenience** Would greater hardship be caused if protection is refused?
**3️⃣ Irreparable Injury** Would you suffer harm that cannot be adequately compensated by money?
### ⚠️ SPEED CAN MATTER
If waiting for notice or a normal hearing could defeat the very purpose of the application, the Court may, in appropriate circumstances, consider **ex-parte interim relief**.
That is why **documents, pleadings, affidavit evidence and the urgency of the situation must be presented properly
